Terms of Service

These Terms govern your access to and use of AetherCompute (the "Service"), operated via aethercompute.app. By accessing the Service you agree to these Terms.
1. The Service
AetherCompute orchestrates elastic AI training and inference workloads on spot GPU capacity across third-party cloud providers. Access is currently granted on an invite basis; we may modify, suspend, or discontinue features at any time.
2. Accounts
- You authenticate via Google OAuth and are responsible for activity under your account.
- You must keep API keys confidential and notify us of any compromise.
- Access is subject to an allow-list; we may approve or revoke access at our discretion.
3. Acceptable use
- No illegal content, crypto-mining outside declared workloads, or attempts to disrupt the Service or other tenants.
- You must have rights to the data and container images you process.
- You are responsible for compliance with the terms of the underlying cloud providers your workloads run on.
4. Spot capacity and service levels
- Spot instances may be reclaimed by cloud providers at any time. The Service provides automated checkpointing and recovery with a target recovery time (see our SLA description on the homepage), but we do not guarantee uninterrupted execution.
- Prices shown on the website are estimates; actual billing is based on metered usage.
5. Your data and credentials
- You retain all rights to your training data, models, and checkpoints.
- Cloud credentials you register are stored encrypted and used solely to operate workloads on your behalf.
- Our Privacy Policy describes data handling in detail.
6. Fees
Where paid usage applies, charges are based on metered GPU-time and related infrastructure costs. We will provide at least 30 days' notice before introducing or changing fees.
7. Disclaimers and liability
- THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
- To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, including lost profits, lost training progress, or data loss, except where caused by our gross negligence or willful misconduct.
- Our aggregate liability is limited to the amounts you paid us in the 3 months preceding the claim (or USD 100 if none).
8. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms. Sections on liability, disclaimers, and data survive termination.
9. Changes
We may update these Terms; material changes will be posted here with a new "Last updated" date. Continued use after changes constitutes acceptance.
